Policy improvement (Work Package 3)
Leader of the work package is German Environmental Agency (UBA).
The work package consists of two groups of activities:
- 3.1 Analysis of the interfaces, links or gaps between the different pieces of EU-legislations and marine convention
- 3.2 Development of method to include information of hazardous substances into BREFs.
Industrial operators and different authorities at the European and local level have to implement several different pieces of legislation and international frameworks which all aim at safe use of chemicals and/or reduction of releases of hazardous substances to the environment. The requirements of the Industrial Emissions Directive (IED), REACH, and waste and product regulations as well as the provisions of the Water Framework Directive (WFD) and HELCOM should all be taken into account.
To improve the implementation of these regulatory frameworks the authorities and the industry need to understand better the interfaces between these frameworks. The aim of the work package is to enhance the capacity of authorities and industrial operators to understand the links between the provisions of the different regulatory frameworks.
Another aim is to develop a methodology for addressing hazardous substances more systematically and at the right time in BREF review process. This would improve the information about hazardous chemicals in the BREFs and eventually lead to better control of hazardous substances through improved permits.
The general aim is to achieve reduced releases of hazardous substances from industry in the region by increasing the institutional capacity of the stakeholders.
Analysis of the interfaces, links or gaps between the different pieces of EU-legislations and marine convention
The activity 3.1 will analyze the interface between:
- the different pieces of EU-legislations and HELCOM concerning the requirements regarding the use and management of hazardous substances
- the Water Framework Directive and BREFs or other EU-legislations (e.g. REACH) and BREFs and HELCOM.

Development of method to include information of hazardous substances into BREFs
This activity 3.2 will develop a methodology for addressing hazardous substances more systematically and at the right time in BREF process. The activity will identify where to find relevant information about less hazardous substances and provide a model solution for how to include information from REACH and other frameworks in the preparation of BREFs.
The work focuses to improve the institutional, process-related and informational aspects of the BREF process and looks at weaknesses and opportunities of the BREF process. As a result it will provide a methodology that addresses the use of hazardous substances in BREFs in a more systematic and evidence supported way. This methodology will be jointly elaborated with the target groups. The activity will also provide a model solution including a work stream that can be applied to other sectors than the three addressed in the project.
The results will also include recommendations on how to use the information from ECHA and BREFs better in the respective regulatory frameworks (REACH, WFD, HELCOM, etc.) and how to include the aspects of Circular Economy into BREFs. The activity 3.2 will wrap up all the results from the HAZBREF project.
